Driver's License Revocation Hearings

Tampa License Revocation Attorney

The Tampa DUI lawyers at Musca Law encourage you to contact our office immediately after you are arrested for DUI. Time is of the essence when it comes to preserving your driving privileges and preparing the best DUI defense possible.

The 10 Day Rule

After a DUI arrest, the Florida Department of Highway Safety and Motor Vehicles immediately suspends your driver’s license. If you do not request an administrative hearing, your driver’s license will be suspended automatically for six months if you agreed to a breathalyzer test or one year if you refused to take the breath test when you were arrested.

Contact the Musca Law Tampa DUI defense attorneys as soon as possible after you are arrested. We will arrange a formal hearing on your driver’s license revocation and provide aggressive representation at your appearance. Prevailing at the administrative license revocation hearing is the only way you can retain your driving privileges following a DUI arrest in the state of Florida.

The DHSMV will issue you a ten day permit. After it expires, you will not be licensed to drive. Driving without a license and driving on a suspended license carry serious penalties in Florida.

How Long Will My License Be Revoked?

If you were not successful or did not request an administrative hearing on your driver’s license revocation, your license will be suspended or revoked for a long period of time. If this is your first DUI, it will be revoked for either six months or one year; if it is your second DUI within the last five years, it will be revoked for five years. Under some circumstances, such as felony fourth DUI and DUI manslaughter, you face permanent revocation of your driver’s license in Florida.

Building a Record

Representation by an experienced Tampa DUI lawyer at your administrative review hearing is vital. Any negative information that comes out in the hearing could be used against you later. An experienced Musca Law DUI attorney can represent you at the hearing, working to preserve your DUI defense in the courtroom at a later date and to retain your driving privileges. Evidence that is in your favor that comes out at your license revocation hearing can also be used in your upcoming DUI criminal case and your Musca Law Tampa DUI lawyer will build the record in your favor.
